THE REIT SPONSOR HAS RECENTLY SUSPENDED DIVIDENDS ON THE REIT. CUSTOMER IS REQUESTING THAT HIS INCOME BE RESUMED OR THAT HIS ORIGINAL CASH VALUE OF $150000 BE RETURNED TO HIS IRA AND BE INVESTED IN AN INCOME BEARING INVESTMENT. IN RESEARCHING THE CUSTOMERS ALLEGATIONS, HE SIGNED ACKNOWLEDGEMENT FORMS WHICH STATED THAT HE UNDERSTOOD THE RISKS INVOLVED IN MAKING THIS TYPE OF INVESTMENT AND THE INVESTMENT FEATURES, INCLUDING BUT NOT LIMITED TO, LOSS OF PRINCIPAL, NO GUARANTEE OF ANY SPECIFIED LEVEL OF RETURN AND THAT THE INVESTMENT MAY FLUCTUATE IN VALUE WITH LIQUIDITY OF THE INVESTMENT SEVERALLY LIMITED DUE TO RESTRICTIONS ON THE RIGHT TO SELL OR EXCHANGE. THE CUSTOMER ALSO ACKNOWLEDGED THAT THE RR HAD DISCUSSED HOW THE INVESTMENT WOULD AFFECT THE CLIENT’S LIQUIDITY NEEDS FOR THE FUTURE AND THAT HE WAS IN A FINANCIAL POSITION TO BENEFIT FROM THIS TYPE OF INVESTMENT. CLAIMS BY THE CUSTOMER WERE DENIED.
