Disclosure #1 for DAVID PHAM

    • eventDate: 3/8/2013
    • Disclosure Type: Employment Separation After Allegations
    • Disclosure Resolution:
    • Disclosure Detail :: Firm Name: UNIONBANC INVESTMENT SERVICES
    • Termination Type: Discharged
    • Allegations: INDIVIDUAL WAS TERMINATED FOR FAILURE TO COMPLY WITH THE BANK’S POLICIES AND PROCEDURES WHICH INCLUDED: USING PERSONAL FUNDS FOR A CLIENT TRANSACTION; FAILURE TO PROPERLY SECURE THE BRANCH RESULTING IN A POTENTIAL BREACH OF BRANCH SECURITY. NO CLIENTS WERE HARMED, NON-SECURITIES RELATED.
    • Broker Comment: 1) USING PERSONAL FUNDS FOR A CLIENT TRANSACTION: A HIGH VALUE CLIENT CAME INTO OUR BRANCH AND REQUESTED NEW MONEY FOR THE CHINESE NEW YEAR. HOWEVER, OUR BRANCH WAS OUT OF BRAND NEW MONEY. SINCE I HAD SOME FOR MY OWN USE IN MY BRIEFCASE, I WANTED TO ACCOMMODATE THE SUBJECT CLIENT AND EXCHANGED MY OWN NEW MONEY FOR THE SUBJECT CLIENT. 2) FAILURE TO PROPERLY SECURE THE BRANCH RESULTING IN A POTENTIAL BREACH OF BRANCH SECURITY: I WAS RECENTLY TRANSFERRED TO THE SUBJECT BRANCH WHICH HAS TWO SETS OF SECURITY DOORS AND AN EMERGENCY DOOR NEXT TO THE SECURITY DOORS. WHEN I DID THE MORNING SEARCH I USED THE EMERGENCY DOOR INSTEAD OF THE TWO SETS OF SECURITY DOORS TO EXPEDITE THE OPENING OF THE BRANCH. THE FACT THAT THESE ISSUES HAVE COME UP HAS TAKEN ME SOMEWHAT BY SURPRISE AS THERE WAS NO CLIENTS HARMED AND NO INCIDENT OF BRANCH SECURITY BREACH.

Should I file a FINRA complaint against brokers like DAVID K PHAM?

Many investors (presumably, like yourself) are unaware of the legal recourse available to them after losing money due to securities broker fraud and/or negligence. The truth is that investors who lost money in this fashion may actually be entitled to damages. You may suffer significant losses at the hands of your financial advisors’ misconduct, such as if they misrepresented or failed to disclose the risks associated with a particular investment, recommended frequent trades for the sole purpose of generating commissions, or used high-pressure tactics to make a sale. The rules and regulations of securities laws and FINRA policies are complex, and investment loss claims require an extensive understanding of securities arbitration to achieve the best possible results.

Update – 2022.11.15If you have suffered investment losses that may have been caused by DAVID K PHAM’s negligence or fraud, contact a FINRA lawyer today. Most FINRA lawyers work on a contingency fee basis, meaning that you will not be charged for their services unless they successfully collect money for you. Kindly add a comment, or contact us directly if you have any query, or want to be contacted by a FINRA lawyer today!
