Went into M&T bank on a Friday morning with a balance of -$22.00 (including an overdraft fee). Rep explained the fee to me, seemed legit (as legitimate as a $37 fee can be anyway). I asked her “If I make a deposit today, will there be any further overdraft fees on my account?” To which she responded (after checking a few things on her computer) “No, you will be fine if you make a deposit now, just make sure it is cash so it will clear in time.” I thanked her, and immediately made a deposit of $260 (as further confirmation, the teller made sure that I was aware my account was overdrawn, I replied “yes I”m aware, the customer service rep told me that if I make a deposit now there won”t be any further fees”, to which she responded “thats a good idea”). I checked my balance online Saturday evening and noticed that there was an additional $37 overdraft fee. I stopped by the bank again on Monday morning and talked to the exact same representative, explaining that I was in on Friday inquiring about an overdraft fee, and she admitted that she recognized me. After reminding her of our conversation, she seemed confused and responded: “hmm… I wouldn”t have said that, because there was still another fee pending…” She then asks me if I would like the fee waived, I replied yes. She verifies my phone number, and says she will call me. I receive a call about an hour later, she states that this bank location can”t waive overdraft fees for me and I will have to call the Airport Plaza location where I opened the account. I call here, explaining the situation to another rep, who tells me a manager will call me back. The manager at the Airport plaza branch calls back and informs me that despite the other rep making a “bank error” they will not waive the fee, because they had waived fees earlier that year. I told her that I did not feel this was pertinent to the situation at hand and explained that I felt I was lied to, and suggested she contact the other rep herself to clear things up, she agreed to do so. The manager again calls back and tells me that the other rep has no recollection of our conversation at all (odd considering she told me she recognized me at first). She then proceeds to berate me like a child, telling me that ultimately I am responsible for keeping track of my own funds and that they would waive the fee this time as a courtesy, but no future overdraft fees would be waived, to which I responded that ultimately it is the bank”s responsibility to stand behind its employees and take responsibility when they give out false information to their customers – she responded again that she was not part of this conversation, and that the other rep had no recollection of it either. So rather than the apology that I should I have received for being lied to I was instead talked down to by the manager of the bank. Needless to say I”m closing my account this week.

We have a commercial loan from M&T Bank. It”s originated by Silver Hill under its subsidiary Bayview Loan Company on Sept. 2007 and Bayview sold to M&T Bank after 7 or 8 months later. The loan is for a small MHP in NC. Recently, our tenants are having problems with their jobs. Consequently, a few can not make their rent payments on time. Therefore, we are having a tough time making a mortgage for many months. However, we tried to make the payment on time and keep our credit intack for the possibility of refinancing the mortgage with low interests and low monthly payment in order to be self sufficient. We called M&T Bank to consider the readjustment or loan modification possibility but M&T told us that we have to be on default status in order to be considered. So, we looked for another bank to refinance the mortgage. However, we found out that our payoff information from M&T Bank for refinancing our mortgage was very disturbing. Terms and early payment penalties were so severe that we do not have the chance. It turned out to be our early payment penalties were over $160, 000 (57%) on the loan amount of $279, 237 and terms were 7 years early payment penalty plus 10 years payment penalty thereafter, which we were not aware of before the contract. There is no written disclosure we can find from the file. I spoke with many business people and loan brokers about it but they never heard such terms. I hired a predatory lending mortgage lawyer and he tried to resolve the problem with M&T Bank directly; however, M&T Bank told him that commercial loan is norm in that terms. Basically, M&T Bank wants $160, 000 penalty if we want to refinance it or rather see the default or foreclosure on the loan. The lawyer told me that he is not expert in commercial loan and we should consult with other commercial mortgage lawyer. Please investigate the term predatory lending practice on these lenders. Are these terms are norm in commercial loan? Isn”t there should be some kind of term restriction for commercial loans? Hope this helps other business people be aware of their loan terms and find the right bank or financial institution for their commercial loans.

There is an erroneous NSF fee posted to my account. I called M&T Bank at 10am on Saturday 5/24/08. The girl who answered the phone told me the NSF fee was posted to a transaction at a mini-mart a week prior to my call. My account online showed it was posted to an ATM withdrawal 2 days prior to my call. She was confused, put me on hold, then came back on and told me that “Josh” would call me back by 12pm. Today is 5/28/08…I still have not heard from “Josh”. I work full time, and do not have the opportunity to go to the branch office or to make repeated phone calls to them. This happened to me in February, too. This bank has taken NSF fees out of my account on numerous occasions for no apparent reason. When I call, they give me a half-baked excuse. I will be closing this account, because what recourse do I have? It”s a bank, they know what they”re doing with my money, right? I don”t think so!! They have also refused to help me with a transaction a different company posted to my account, which resulted in an NSF fee. The other company refunded me, but will not send a letter to M&T on my behalf to have the NSF fee reversed. I offered to fax the email stating that to M&T, they said basically that I”m out of luck. I have all the emails that went back and forth between myself and an M&T customer service rep, and the emails from the other company that I should be able to use to clear this up. M&T is more interested in keeping my money than in helping me clear up an error on my account.

The final straw was today. Ever since M&T bought Provident, whom I banked with for almost a decade, I have had expensively bad and unethical service. M&T took over and NEVER annouced their fee structure and raised it w/o informing me, their customer. They did away with Provident”s lockbox checking practices that held money that had pending transactions against it, decreasing the liklihood of overdrafts. Now, M&T takes transactions and manipulates the processing time so that they can charge NSF fees. It doesn”t matter if you catch your mistake and deposit CASH to cover it, they still charge it and justify it by saying that they credit cash AFTER you did the original transaction. They have poor real estate for their ATMs causing me to use other ATMs and incur fees as a result. I have been laid off and am in the Air National Guard. After the government rectified a pay mistake that they caused, I went almost a month w/o pay and incurred some overdrafts. I KNEW that I would have to pay the fees, as distateful as that is. I realize there are consequences for my actions. However, when I had a deposit go in and I made everything good, I found that M&T had a 24 hour hold on my account. When I called Sustomer support they told me that it was their policy and that it could not be waived. I pointed out that I had a positive balance and that the bank made some decent fees off of me and that they were holding my money hostage. To add insult to injury, the CSR hung up on me. I have had conversations with Asst Branch managers who have confided in me their disatisfaction with their new employer. In all, I estimate that I have paid upwards of $800 in fees since the takeover. That does not take into account the fact that many of my transactions that were heretofore honored by Provident were manipulated into NSF status by their unethical practices. I am finally closing my account and am putting the word out aboutr these userious bandits, in my opinion.

The bank is horrible… I had someone get my account information and charge hundreds of dollars to it, making it go negative and accrue hundreds more in over draft fees. I called the bank immdeiatley and told them something was goin gon and to freeze my account. Instead of getting help I got a snappy reply and then got told I was a liar and trying to file false charges. I hung up and went to the branch to speak with manager. I got the same response here and they refused to help me. So I then got corporates number and celled then where they refunded me half the money and refused to refund me the rest. Then asked me when I will be paying off my balance owed to them. I told them never and that my lawyer will be in contact with them. They hung up and I never heard back and nothing ever showed on my credit. A year later my BF had an account with them and his wallet was stolen while he was at the gym. They did the same thing to him and said they were going to take legal action against him for filing false claims. This is absurd never had any issues with bank account always had a positive balance had great credit and thye did this to not just me but my BF as well. Crummy bank and treats customers like crap. If I ever see anything on my credit report better believe I will sue.

Spoke to several people at your Homeowner Assistance Center. On Wednesday 3/20/19, I spoke to a customer service representative, and she was very courteous and helpful and we resolved several issues that I had called about. On Thrusday 3/21/19, I spoke to a customer service representative, and he was also very courteous. I asked to speak with a Supervisor and was transferred to a gentleman whose first name was Jeremy. I am sorry to say that jeremy was less than courteous, he was abrupt and borderline rude. My complaint was and is as follows: Because my mortgage payment was increased due to a tax increase, (and I was not aware of that), my payment which was received on 12/24/18 was less than the new payment amount that was due. Mt&t applied it to principal only and continued to do so for 3 months, causing me to incur significant late charges for 3 consecutive months until I discovered what was going on. Your representative showed very poor customer skills, and I am shocked to see that he is a customer service supervisor. He showed no willingness to even consider reversing the late charges, as I requested, and he was very dogmatic in is dealings with me. I will act immediately to move my mortgage to a different bank, but wanted someone in corporate to be aware of a policy that would cause a good customer to have to pay over $400.00 in late charges when it could have been avoided. September 2013 M&T purchased my loan the principal balance was$230, 581, however, the principle bal was changed by them to $236, 019. After numerous certified mail from me to the CEO of the company and to customer service, a response was sent to me stating some of the additional charges to my principal balance were fees they added: a certified mail fee, fees for a title search, foreclosure attorney fees, a publication cost and past interest of $3659. I was never in foreclosure the loan was always current.in March 2016 I contacted M & T and was told my account was past due. I never recalled missing a payment. I paid my bank to furnish banking statement going back to September 2011 forward all payments to M&T were made. They did not get my loan until 2013. I could not get anywhere I paid two months to M&T in order for them to consider the account current. There was never a previous balance showing on any statement I received from them. I requested an itemization of the account they said I would need to send $20.00 for that to be done. I mailed them $20 and received a document that was not legible. November 3, 217 I received a call from them. I called today 11-6-17 to see what the call was about. I was told I did not make my October payment. I told them I paid on 10-4-17 the lady then said she sees the payment and they called on 11-3-17 because they did not have my November 2017 payment. I have reported to Consumer Protection, to Freddie Mac and still no resolution.
